Overzealous prosecutors Pt. 2

Chula Vista City Councilman Steve Castaneda appears to be getting the Patrick Fitzgerald treatment from Prosecutor Patrick O'Toole of the San Diego County District Attorney's Public Integrity Unit.

Castaneda has been charged with perjury "for allegedly lying about whether he thought about buying one of the Sunbow condominiums."

When asked in front of the grand jury about whether he "thought" about buying one of the condos he said: "No."

At least one witness testified that Castaneda asked about the price of a condominium, according to the transcript. O'Toole said he believes that indicates Castaneda wanted to buy one, even though he didn't ultimately do so.

Think about that "proof" for a second? Have you ever driven by a house for sale and picked up one of the fliers they have in a pouch on the for sale sign? Apparently you thought about buying that house.

What a load of baloney. Mere curiosity about the price of any item, in the eyes of the Public Integrity Unit, is now evidence of an intent to purchase said item.

I wonder if Castaneda has ever thought about eating a ham sandwich -- or could he get indicted for that too?

  1. When he was asked the question on the stand, he had to think about it, therefore the answer literally has to be yes.

    Or, I refuse to answer..., which seems to be the best answer to law enforcement these days.
