South Dakota Republicans can't count

Apparently South Dakota's Republicans have been buying into Planned Parenthood/NARAL propaganda and are convinced that with Justice Samuel Alito's confirmation to the Supreme Court, Roe v. Wade is ripe to be overturned (in fairness, the bill got at least one Democrat's support too). How else do you explain the state legislature's decision to pass a law outlawing abortion in all cases except to save the life of the mother?

Even if Chief Justice John Roberts and Alito are the pro-life votes that every Republican hopes and expects them to be, you've only got four votes (with justices Antonin Scalia and Clarence Thomas) to overturn Roe.

Even if Justice John Paul Stevens or Justice Ruth Bader Ginsberg decide to retire (or die) while Bush is still in the White House, it's going to be tough enough to get another conservative on the court without this legal battle looming.

Call it premature legislation.
