Stanford law professor Lawrence Lessig predicts the end of the public domain in 25 years. To illustrate the previous bullet point, the Supreme Court would be doing its job if it struck down the serial and predictable extension of the copyright law that Congress passes everytime the previous one is about to run out. That wouldn't be "judicial activism" because it struck down a law enacted by Congress, it would be valid "judicial review" because the law is in conflict with the written constitution.
