Viewpoint discrimination

The 2nd Circuit Court of Appeals ruled today that Zachery Guiles can wear a T-shirt to school that labels President Bush the "Chicken-Hawk-In-Chief" and accuses him of being a cocaine addict and drunkard.

In other news, the Ninth Circuit Court of Appeals -- the one with all the liberal, free speech absolutists -- still thinks believes that a T-shirt stating simply that "homosexuality is shameful" is beyond the pale.

It appears that we now have a circuit split. If the Ninth Circuit persists in its viewpoint discrimination, then the Supreme Court might finally settle this.

  1. I would like to hear how the circuits would rule on a case where a student has a T-Shirt that says "Bush is a faggot."

  2. I would like to see how the circuits would rule on a case where a student has a T-Shirt that disses affirmative action or radical Islam. Because some animals are more equal than others.
