During Wednesday's hearing on the Texas redistricting plan, Justice Ruth Bader Ginsburg made a visit, as the Washington Post's Dana Milbank put it, to the "land of nod." If I were arguing the case before the court today, I'd be angry that a Justice who is supposed to decide the case can't be bothered to stay awake. At the very least, Ginsburg needs to make a public apology for her eye-resting behavior. If she can't stay awake through a two-hour afternoon hearing, then she needs to step down, even if it does mean that that pesky George W. Bush gets to appoint her successor.
The best overall account of the hearing I could find was by Slate's Dahlia Lithwick which reads a lot like a live-blogging post. If the justices' questions -- those that were awake -- are any indication, then it's highly likely that this redistricting plan will stay in place.
