Southwick filibustered

I know you're thinking I've got the story wrong, but Judge Leslie Southwick was filibustered yesterday on his way to finally winning Senate confirmation to a seat on the Fifth Circuit Court of Appeals.

You can find a list of the 35 senators who filibustered Southwick here. Yes, you're a smarty. You know that it takes 41 senators to filibuster. But you're not the New York Times editorial board.

Oddly, it seems as though the newsroom at the Times hasn't gotten the memo on what constitutes a filibuster and what does not. From today's Times story:

But Judge Southwick was assured of his “yes or no” vote earlier today when the Senate voted, 62 to 35, to invoke cloture, a parliamentary step that ends debate and precludes a filibuster.

Maybe the Times should invite a constitutional scholar -- like a high school civics teacher -- to straighten out this dispute.
